Welcome to TikSnap. By accessing and using our website (www.tiksnap.es) and its associated services (the "Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of them, do not use the Service.

1. Eligibility

To use the Service you must be at least 18 years old (or the age of majority in your country). The Service is not available where its use is prohibited by law. By accepting these terms, you represent that you meet this requirement.

2. Description of the Service

TikSnap is a free web tool that lets users download videos and extract audio from the TikTok platform. The Service acts as a technical intermediary: it processes public TikTok links and returns the media file without adding watermarks. TikSnap does not host, store or redistribute content on its own servers beyond the time necessary to complete the download.

The Service is offered free of charge, "as is" and "as available". We reserve the right to modify, suspend or discontinue any feature at any time, with or without notice.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for personal, non-commercial purposes. This license does not allow you to reproduce, distribute, modify or commercially exploit the Service or any of its components. We may revoke this license at any time and without notice if you breach these terms.

4. Acceptable Use

By using TikSnap, you agree to do so responsibly and in compliance with the law. You agree that:

• You will use downloaded content only for personal, non-commercial use, unless you have express authorization from the rights holder.
• It is your responsibility to verify that you have the necessary rights to download and use any content obtained through TikSnap.
• You will not redistribute, resell or use downloaded content in any way that infringes the rights of third parties.
• You will not use the Service for illegal, fraudulent or malicious purposes.
• You will not interfere with the operation of the Service, including through the use of bots, crawlers, automated scripts or any method that places excessive load on our infrastructure.

5. User Conduct and Zero-Tolerance Policy

The following is strictly and expressly prohibited:

• Zero Tolerance for CSAM: Using this Service to download, process, view or distribute Child Sexual Abuse Material (CSAM) or any content involving the sexualization of minors is absolutely prohibited. TikSnap does not condone, facilitate or take part in such acts under any circumstances.
• Using the Service to download protected content for the purpose of infringing copyright.
• Creating competing services, replicas or derivatives using our infrastructure or code.
• Circumventing, disabling or interfering with security measures, usage limits or any technical restriction of the Service.
• Sending mass automated requests, including but not limited to scraping, data mining or generating artificial traffic.
• Impersonating others, tampering with identifiers or falsifying the origin of requests.
• Introducing viruses, malware or any code designed to disrupt, damage or limit the functionality of the Service or of third parties.
• Using the Service to harass, threaten or harm other users or third parties.

Legal Notice and Law Enforcement Cooperation: We reserve the absolute right to monitor the Service, log IP addresses and analyze activity in order to detect prohibited uses. If we detect downloads of content involving minors in unlawful situations, TikSnap will permanently block the offender's access and will actively cooperate by handing over logs, IP addresses and timestamps to the competent law enforcement authorities and to international organizations (such as NCMEC) for criminal prosecution.

6. Intellectual Property

All content on the TikSnap website, including the design, logos, text, graphics, source code, interfaces and the "TikSnap" brand, is the exclusive property of TikSnap and is protected by intellectual property laws. Its reproduction, modification or unauthorized use is prohibited.

Videos downloaded through the Service belong to their respective creators or rights holders. TikSnap claims no ownership over that content. TikTok and its logo are registered trademarks of ByteDance Ltd. TikSnap is not affiliated with, sponsored by or associated with TikTok or ByteDance.

7. Copyright Policy (DMCA)

TikSnap respects the intellectual property rights of third parties and complies with the Digital Millennium Copyright Act (DMCA). If you believe your content is being distributed without authorization through the Service, see our DMCA Policy to submit an infringement notice. We address valid notices within a maximum of 48 business hours.

8. Limitation of Liability

In no event shall TikSnap be liable for:

• Direct, indirect, incidental, special or consequential damages arising from the use of or inability to use the Service.
• The accuracy, completeness or usefulness of the content processed.
• Interruptions, errors, viruses or harmful elements that may affect your device.
• The content of downloaded videos, which is the sole responsibility of the original creators.
• How users make use of content downloaded through the Service.
• The content, policies or practices of third-party websites linked from our site.

Your sole remedy for any dissatisfaction with the Service is to stop using it. In no event shall our total liability exceed 100 USD.

9. Indemnification

You agree to defend, indemnify and hold harmless TikSnap, its owners, contributors and affiliates from any claim, demand, loss or expense (including reasonable attorneys' fees) arising from: (i) your use of the Service, (ii) your violation of these Terms, (iii) your infringement of third-party rights, or (iv) any content you download or share using the Service.

10. Advertising and Third-Party Links

TikSnap is supported by advertising served by Monetag. The formats we use are ads that open in a new tab when you click on the page and, only if you accept the browser permission, push notifications. No ad is part of the download process: the download buttons are the ones shown in TikSnap's results and never require interacting with advertising.

Advertising may be personalized and is managed by Google. See our Privacy Policy for more information about cookies and advertising. We have no control over the content of ads displayed by third parties.

11. Privacy

Your use of the Service is subject to our Privacy Policy, which forms part of these Terms. By using TikSnap, you accept the practices described in that policy.

12. Changes to the Terms

We may modify these Terms at any time. Changes will be posted on this page with a revised last-updated date. It is your responsibility to review them periodically. Continued use of the Service after any change constitutes your acceptance of the new terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Dominican Republic. Any dispute shall be submitted to the exclusive jurisdiction of its competent courts. You expressly waive any objection based on inconvenient forum.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and TikSnap regarding the use of the Service and supersede any prior agreements. A waiver of one provision does not constitute a waiver of any other.
