Welcome to TikSnap. By accessing and using our website (www.tiksnap.es) and the associated services (hereinafter, the "Service"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of them, do not use the Service.

1. Eligibility

To use the Service, you must be at least 18 years old (or the age of majority in your country). The Service is not available where its use is prohibited by law. By accepting these terms, you declare that you meet this requirement.

2. Description of the Service

TikSnap is a free web tool that allows users to download videos and extract audio from the TikTok platform. The Service acts as a technical intermediary: it processes public TikTok links and returns the media file without adding watermarks. TikSnap does not host, store or redistribute content on its own servers beyond the time necessary to complete the download.

The Service is offered free of charge, "as is" and "as available". We reserve the right to modify, suspend or discontinue any functionality at any time, with or without prior notice.

3. License to Use

We grant you a limited, non-exclusive, non-transferable and revocable license to access and use the Service exclusively for personal and non-commercial purposes. This license does not allow you to reproduce, distribute, modify or commercially exploit the Service or any of its components. We may revoke this license at any time and without prior notice if you breach these terms.

4. Acceptable Use

When using TikSnap, you undertake to do so responsibly and in accordance with the law. You agree that:

• You will use the downloaded content only for personal and non-commercial use, unless you have the express authorization of the rights holder.
• It is your responsibility to verify that you have the necessary rights to download and use any content obtained through TikSnap.
• You will not redistribute, resell or use the downloaded content in a way that infringes the rights of third parties.
• You will not use the Service for illegal, fraudulent or malicious purposes.
• You will not interfere with the operation of the Service, including the use of bots, crawlers, automated scripts or any method that imposes an excessive load on our infrastructure.

5. User Conduct

The following is expressly prohibited:

• Using the Service to download protected content in order to infringe copyright.
• Creating competing, replica or derivative services using our infrastructure or code.
• Circumventing, disabling or interfering with security measures, usage limits or any technical restriction of the Service.
• Sending mass automated requests, including but not limited to scraping, data mining or generation of artificial traffic.
• Impersonating identities, manipulating identifiers or falsifying the origin of requests.
• Introducing viruses, malware or any code designed to interrupt, damage or limit the functionality of the Service or of third parties.
• Using the Service to harass, threaten or harm other users or third parties.

We reserve the right to monitor, record and analyze activity on the Service to detect prohibited uses. We may restrict, block or deny access to any user who breaches these rules, without prior notice and without any right to a refund (given that the Service is free).

6. Intellectual Property

All content on the TikSnap website, including the design, logos, texts, graphics, source code, interfaces and the "TikSnap" brand, is the exclusive property of TikSnap and is protected by intellectual property laws. Its reproduction, modification or unauthorized use is prohibited.

The videos downloaded through the Service belong to their respective creators or rights holders. TikSnap does not claim ownership of that content. TikTok and its logo are registered trademarks of ByteDance Ltd. TikSnap is not affiliated, sponsored or associated with TikTok or ByteDance.

7. Copyright Policy (DMCA)

TikSnap respects the intellectual property rights of third parties and complies with the Digital Millennium Copyright Act (DMCA). If you are a rights holder and believe that our Service facilitates unauthorized access to your content, you may send us an infringement notice to tiksnap.es@gmail.com with the subject "DMCA Notice". The notice must include:

1. Identification of the protected work allegedly infringed.
2. Identification of the infringing material and its location on our site.
3. Your contact information (name, address, email, phone).
4. A statement of good faith that the use is not authorized by the owner.
5. A statement under penalty of perjury that the information is accurate.
6. Your physical or electronic signature.

We will address all valid notices within a maximum of 48 business hours. As part of our repeat infringer policy, any user against whom three valid notices are received within a six-month period will permanently lose access to the Service.

8. Limitation of Liability

Under no circumstances shall TikSnap be liable for:

• Direct, indirect, incidental, special or consequential damages arising from the use or inability to use the Service.
• The accuracy, completeness or usefulness of the processed content.
• Interruptions, errors, viruses or harmful elements that may affect your device.
• The content of downloaded videos, for which the original creators bear exclusive responsibility.
• The use that users make of content downloaded through the Service.
• The content, policies or practices of third-party websites linked from our site.

Your sole remedy for any dissatisfaction with the Service is to stop using it. Under no circumstances shall our total liability exceed 100 USD.

9. Indemnification

You agree to defend, indemnify and hold harmless TikSnap, its owners, collaborators and affiliates, from and against any claim, demand, loss or expense (including reasonable legal fees) arising from: (i) your use of the Service, (ii) your breach of these Terms, (iii) your infringement of third-party rights, or (iv) any content you download or share using the Service.

10. Advertising and Third-Party Links

TikSnap is maintained through third-party advertising. When using the Service, you may encounter:

• Opening ad: When the site loads, an ad may appear that closes automatically.
• Per-download ad: When you click a download button, a new tab with third-party advertising will open. The download will start automatically afterwards.

We have no control over the content, privacy policies or practices of third-party sites. We assume no responsibility for them. We recommend you read their terms before interacting with them.

11. Privacy

The use of the Service is subject to our Privacy Policy, which forms part of these Terms. By using TikSnap, you accept the practices described in that policy.

12. Modifications to the Terms

We may modify these Terms at any time. Changes will be posted on this page with a revised last updated date. It is your responsibility to review them periodically. Your continued use of the Service after any change constitutes your acceptance of the new terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Dominican Republic. Any dispute shall be submitted to the exclusive jurisdiction of its competent courts. You expressly waive any objection based on forum non conveniens.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and TikSnap regarding the use of the Service and supersede any prior agreement. The waiver of one provision does not constitute a waiver of any other.
